THCA Laws in Idaho

Hemp-derived THCA is federally legal under the 2018 Farm Bill when sourced from hemp containing โ‰ค0.3% ฮ”9-THC on a dry weight basis. Idaho has enacted laws that treat THCA as a controlled substance, effectively banning it.

Federal vs. State Law

The 2018 Agriculture Improvement Act (Farm Bill) legalized hemp and hemp-derived cannabinoids at the federal level. THCA โ€” tetrahydrocannabinolic acid โ€” is the non-psychoactive precursor to THC found in raw hemp. When heated, THCA converts to THC via decarboxylation.

However, states retain the right to regulate hemp products within their borders. Some states calculate "total THC" to include THCA (using the formula: Total THC = THCA ร— 0.877 + ฮ”9-THC), which can cause high-THCA flower to exceed the 0.3% limit even if ฮ”9-THC alone is compliant.
